Introduction
These terms and conditions ("Product Terms and Conditions") apply to all transactions concluded with you, the customer; via this UK CPAP website (the "Website") please read them carefully before placing your order and print a copy for your future reference. By using the Website you accept and agree to be bound by the Product Terms and Conditions and the Web Site Terms and Conditions, which together shall constitute the entire agreement between you and CPAP Solutions Limited ("CPAP Solutions Limited").
If you do not agree to the Product Terms and Conditions or the Web Site Terms and Conditions you should leave the Website.
CPAP Solutions Limited reserves the right to alter or amend the Product Terms and Conditions at any time without notification to you. Specifically CPAP Solutions Limited can amend, discontinue or remove content displayed on the Website, including product and service information or specification on the Website, without liability.

Returns Policy
Return Undamaged Products:
If for any reason you are unhappy with your purchase you can return it to us in its *original condition within 14 days of the date you received the item and we will issue a full refund for the price you paid for the item excluding the postage. You can expect a refund in the same form of payment originally used for the purchase within 5 days of our receiving your return. If you require an exchange, please place a new order online.
Please email sales@ukcpap.co.uk with your order/shipment number, and which items you wish to return, to obtain a returns number which needs to be written on the outside of the parcel. Please state a reason for your return.

Items returned because they are damaged, defective or incorrect:
If you are returning an item because of an error on our part or because it is damaged or defective, we will refund the delivery charges incurred in sending the item to you and pay your costs of returning it to us by refunding your return postage costs. You can expect a refund in the same form of payment originally used for the purchase within 5 days of our receiving your return. UK CPAP will check all items returned as damaged or defective. In the event we find no fault, we reserve the right to re-charge you for the item/s and to recover our fees and expenses from you.
We may require pictures of all damages to goods and the packaging.

Rent And Hire Purchase
In the case that you are renting or renting to buy an item please see further terms and conditions below
THIS AGREEMENT CANNOT BE CANCELLED and is subject to the following TERMS AND CONDITIONS:
1) TERM: The term of the rental is for the period paid for by the Lessee and commences on the date the equipment is received in full by the Lessee and ends the date the same equipment is returned in full by Lessee to the Lessor.
2) DEPOSIT: The deposit paid in connection with this rental agreement represents a security for the equipment rented for rental period. The deposit will be treated as follows: a. A refund of the deposit amount received by Lessor will be made if the rental application is not accepted by Lessor or, b. A credit note for the entire deposit amount will be made if Lessee elects to buy the equipment rented or the same equipment as new after the lease period and when all outstanding funds have been paid in full.
3) RENT AMOUNT: The rent amount is unique to the equipment rented and the duration of the agreement. The rent period can be extended subject to a new application and payment.
4) PURCHASES: if you wish to buy the machine you are currently renting, see 2(a).
5) INDEMNITY: Lessee shall indemnify Lessor against, and hold Lessor harmless from, any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including reasonable legal fees arising out of, connected with, or resulting from the property subject to this lease, including, but not limited to the manufacture, selection, delivery, use, operation, or return of such property.
6) LOSS OR DAMAGE: Lessee assumes and shall bear the entire risk of loss, theft, destruction, or damage of or to any part of the equipment (“loss or damage”) from any cause whatsoever, whether or not covered by insurance, and no such loss shall release Lessee of its obligation under this agreement in the event of loss or damage. Lessee, at the sole option of Lessor, shall (a) at Lessee’s expense, repair the equipment to the satisfaction of Lessor; or (b) at Lessee’s expense, and to the satisfaction of Lessor, replace the equipment with similar or like equipment in good condition and repair and of comparable value, with clear title thereto in Lessor; or (c) make payment to Lessor the total of £500, in addition to the deposit.
7) INSURANCE: Lessee shall provide, maintain, and pay for (a) insurance against the loss or theft of or damage to the equipment, for its full replacement value, naming Lessor as a loss payee and (b) public liability and property damage insurance naming Lessor as an additional insured.
8) ASSIGNABILITY: Without Lessor’s prior written consent, Lessee shall not (a) assign, transfer, pledge, or otherwise dispose of this lease, the equipment, or any interest therein or (b) sublet or lend the equipment or permit it to be used by anyone other than Lessee. Lessor may assign this lease or grant a subsidiary interest in the equipment in whole or part without notice to Lessee, and Lessor’s assignee or secured party may then assign this lease or the security agreement without notice to Lessee. Each such assignee or secured party shall have all the rights, but none of the obligations, of Lessor under this lease. Lessee shall recognize such assignments or security agreements and shall not assert against the assignees or the secured parties any defence counterclaim or offset Lessee may have against Lessor. In spite of any such assignment, Lessor warrants that Lessee shall quietly enjoy use of the equipment, subject to the terms and conditions of this lease. Subject to the foregoing, the lease ensures to the benefit of and is binding on the respective heirs, legatees, personal representatives, successors, and assigns of Lessor and Lessee.
9) MAINTENANCE: Lessee, at Lessee’s expense, shall maintain the equipment in good condition and functional order, shall not use the equipment unlawfully, and shall not alter the equipment without Lessor’s prior written consent. Lessor shall not be liable for loss of profit or other consequential damages resulting from the theft, destruction, or disrepair of the equipment, and there shall be no abatement of lease payments on account of any such theft, destruction, or disrepair.
10) SURRENDER: On expiration of the lease term, Lessee shall return the equipment in good repair, ordinary wear and tear excepted, to the address of Lessor. Lessee must be aware of the starting and ending date of the lease. If in case the Lessee wishes to buy the machine he/she currently renting or somehow interested to extend leasing period, please do contact us through email or give us a call a week before (7-days) the expiration of the lease term. Failure to return the machine on time will only result another month rental payment charged to the Lessee using his/her card presented to this agreement.
11) TITLE; PERSONAL PROPERTY: The equipment is, and shall at all times remain, property of Lessor, and Lessee shall have no right, title, or interest except as expressly set forth in this lease.
12) NOTICES AND DEMANDS: Service of all notices under this agreement shall be sent addressed to the party involved at its respective address set forth above or to such other address as the parties may hereafter substitute by written notice.
13) MISCELLANEOUS: This instrument constitutes the entire agreement between Lessor and Lessee and is irrevocable for its term and it shall not be amended, altered, or changed except by a written agreement signed by the parties. If any portion of this lease is deemed to be invalid, it shall not affect the rest of this agreement. Headings or titles to the paragraphs of this lease are solely for the convenience of the parties and not an aid to the interpretation of this agreement. Lessee applies to Lessor for a lease of the above-described property for personal use and agrees that this lease is not to be construed as a consumer contract. If Lessor accepts these terms and conditions, Lessee agrees to rent from Lessor and Lessor agrees to rent to Lessee, the equipment, on all of the terms and conditions of this lease.
14) ACKNOWLEDGEMENT: Lessee and Lessor hereby acknowledge that both read and understand this agreement.
Payment Terms
Prices:
Goods are invoiced in pounds (£) sterling at the price prevailing at the time you place your order. Prices are inclusive of VAT. Prices are expressed exclusive of delivery charges. Delivery charges will be added to the price of the goods purchased so that the on-line order form shows the total charges which we will debit.
The prices indicated apply only to on-line purchases and are not indicative of the price of identical goods purchased by any other means.
We reserve the right to amend any prices without any prior notice and to end any promotions at any time. We reserve the right to add or withdraw any item at any time. UK CPAP will try to ensure that all prices displayed are correct and within the company's pricing structure. In the event that an incorrect price is advertised, we shall amend such price upon notification. We are under no obligation to supply any product that is priced incorrectly.
Credit Card Payments
We are unable to accept credit [or debit] cards that are due to expire within the next FIVE days. Card details are checked and verified by a third party and goods are despatched once authorisation has been obtained by UK CPAP.

Shipping and Delivery
Delivery is deemed to take place when the goods are delivered to your nominated delivery address, whereupon the risk of loss, breakage and damage passes to you. Ownership of the goods does not pass to you until payment is received in full by UK CPAP.

Provided purchased items are in stock, all goods will be dispatched within 4 working days from receipts of cleared funds. Unless otherwise notified.
All items are subject to stock availability. If for any reason the goods are no longer available we will notify you immediately and either: give you the option of receiving alternative goods of similar price and quality; or cancel the item from your order and refund you in full. If the carrier is unable to deliver the goods they will be held by the carrier and a card left stating that a delivery was attempted. No goods will be left in sheds, garages, gardens or outhouses. A member of UK CPAP will contact the customer to make alternative delivery arrangements. Re-delivery will be attempted for a maximum of two occasions. If a parcel is still undelivered it will be returned to UK CPAP and the customer will be notified of its return. The customer will be responsible for the cost of the return.
At UK CPAP we are committed to providing our customers with the highest quality products. All goods are warranted to be generally free from defects in workmanship and materials and fit for the purposes for which such goods would normally be used. However, on rare occasions products may be found to be faulty or defective and in keeping with our commitment to providing customers with excellent service, we offer the returns policy set out above.
All returns are the responsibility of the customer UK CPAP will only cover the cost of faulty or damaged returned goods.

You are entitled to view the Website and to print pages of the Website for the sole purpose of placing an order with UK CPAP. These Purchase Terms and Conditions and the Web Site Terms and Conditions and any contracts made under them are governed by the laws of England and Wales and disputes arising here from shall be subject to the exclusive jurisdiction of the courts of England and Wales. Materials on the Website are not necessarily appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. Visitors accessing the Website from locations outside the United Kingdom do so at their own risk and on their own initiative and are responsible for compliance with local laws.
